Legal entity WhichWay s.r.o. with its registered office at Kaprova 42/14, Staré Město, 110 00 Prague, registered under the file number C 368005/MSPH Municipal Court in Prague, (hereinafter referred to as "WhichWay"), which is the operator of this website, considers the protection and confidentiality of personal data to be very important, and, as the data controller, takes care to process personal data in accordance with Regulation (EU) 2016/679 of the European Parliament and of the Council on the protection of natural persons with regard to the processing of personal data and on the free movement of such data, and repealing Directive 95/46/EC ("GDPR").

WhichWay is a personal data controller primarily in relation to the personal data of authorised or contact persons of customers and potential customers. This personal data is processed and stored in the customer database. It is also the data controller in relation to the personal data of its employees and business partners.

What personal data we process and why

WhichWay processes personal data solely for the purposes of providing its services to customers, safeguarding legitimate interests and fulfilling legal obligations. We aim to process only up-to-date and accurate personal data. So please keep us informed of any changes to the personal data you have provided to us.

The personal data that we process about employees, statutory representatives, contact and authorised persons, customers or potential customers is primarily obtained directly from the data subject at the time of entering into a contract or, where applicable, communicated by the data subject at a later stage during the contractual relationship. All personal data that arise from our communication and interaction with each other are governed by an internal data protection system.

Within the scope of our activities, we process various types of information, which can, however, be broadly divided into the following categories:

(a) Identification data, which include in particular title, name, surname, job title, address for the purpose of concluding a contract;

(b) Contact data, which includes in particular telephone number, email address and workplace email address for the purpose of confirming the conclusion of the contract, performance of services and ensuring communication in the context of business negotiations;

(c) Transaction data, which includes in particular payment data and, where applicable, other data arising from the services provided to our customers and business partners;

(d) Data included in communications, which includes in particular any personal data provided by employees, statutory bodies, authorised or contact persons of business partners, customers and potential customers in the course of their dealings with us, including any contact made between us, whether in person, by telephone, email or online, but also the actual content of the communication with the person concerned (the content of email communications) and the extent and manner of the service provided;

(e) Data necessary to improve the quality of the service, which includes the customer's IP address and cookies when using the website.

We process most of the personal data for the purpose of providing cleaning services and providing client service to our customers. The provision of customer personal data is a contractual obligation. Personal data and other data to the above extent may be processed for the purpose of communicating with the subject via email, telephone call, postal correspondence or by sending SMS in matters relating to the processing of the subject's order / complaint / enquiry.

We may process identification data, contact data and transaction data for the purpose of the safe and proper performance of the contract, i.e. for example to verify an instruction from an authorised person of the customer. The provision of this personal data is a contractual obligation and failure to provide it would prevent us from effectively and safely performing the contract with the client.

For the purpose of offering our related services, establishing, maintaining and deepening business relationships and contacts with our business partners, customers, i.e. for example for the purpose of sending commercial, but also other non-commercial offers, we may process identification data and contact data of statutory representatives, authorized or contact persons of customers. The provision of personal data in this case is not a legal or contractual obligation and the failure to provide it does not have negative consequences for the person concerned.

Legislation and Czech legislation also obliges us to process personal data in certain cases. This typically involves the storage of data in accordance with legal requirements (tax regulations).

We process the personal data of our employees for the purpose of fulfilling the legal obligations of the employer and maintaining the personnel and payroll agenda. In the case of a successful job applicant, we process the applicant's personal data for our recruitment needs in order to be able to sign an employment contract with the applicant.

Ensuring the protection of customers' personal data

We comply with the technical, personnel and other necessary measures to prevent unauthorised or accidental access to, alteration, destruction or loss of personal data, unauthorised transfers, other unauthorised processing or other misuse of personal data.

We provide our services only through persons whose personal and professional qualities provide sufficient guarantees of proper compliance with the conditions for handling personal data.

We have trained our employees on the inviolability of our customers' and third parties' belongings so that no data is lost or misused. In particular, employees must not inspect written documents stored in the premises where cleaning is carried out, make copies or extracts from these documents, or intercept data on the premises in any way.

We shall maintain confidentiality of personal data and security measures, the disclosure of which would compromise the security of personal data, even after the termination of the contract.

Transfer of personal data

We only use personal data to provide our services, protect it from misuse and do not disclose it to third parties without prior notice or consent. The exceptions are external entities that provide support services for us and public authorities. We may or must provide your personal information to these entities to the minimum extent possible, for example, when:

Compliance with a relevant legal regulation or an enforceable request from a public authority,

the application of relevant contractual terms and conditions, including investigation of possible breaches,

to deal with criminal offences, technical complications or security incidents, to protect against damage to the rights, property and/or safety of our employees, customers or the public as required or permitted by law, to provide services and administer applications, to provide technical and IT services, to provide advice and consultancy.

We provide personal data to authorised processors on our instructions. We contractually require all such service providers (other than public authorities) to process your personal data in accordance with the terms of their contracts and applicable legislation. We always ensure that we do not provide more data than is necessary to achieve the purpose of the processing.

We also guarantee that no personal data is transferred to third countries outside the European Union or to international organisations as part of our processing. Neither is the processing carried out by automated decision-making or profiling.

Duration and retention of personal data

We process and store the personal data of customers and third parties for the period necessary to ensure all rights and obligations arising from the contract, and for the period for which we are obliged to retain the data under generally binding legal regulations.

After this period, we are only entitled to process your personal data for compatible purposes or for special purposes (archiving or statistics).

We only store personal data electronically on WhichWay's facilities or with our trusted partners and physically on WhichWay's premises and under the supervision of responsible persons.

The rights of those whose data is processed

You have the right to ask us to confirm whether we are processing personal data relating to you. Where applicable, you may contact WhichWay to exercise your right to access your personal data, correct inaccurate data, complete incomplete data or erase or restrict processing. You have the right to object to processing, exercise your right to data portability and other rights under the General Data Protection Regulation.

If you are convinced that we do not treat your data adequately and in accordance with legal standards, you have the possibility to file a complaint with the supervisory authority, which is the Office for Personal Data Protection, located at Pplk. Changes to these rules

We regularly review this document and reserve the right to change it. If there are any changes to the rules affecting your rights, we will notify you in an appropriate manner.
